How Does North Carolina Law Define Child Pornography?

First-Degree Sexual Exploitation of a Minor

These offenses involve the manufacture of child pornography, as well as transporting a minor across state lines for the purpose of creating child pornography. First-degree sexual exploitation of a minor is a Class C felony, punishable by a prison sentence between 44 and 182 months.

Second-Degree Sexual Exploitation of a Minor

These offenses include the recreation or duplication of child pornography, such as taking a photograph of an existing image. They also include buying or selling any media that depicts a child engaged in sexual activity. Second-degree sexual exploitation of a minor is a Class E felony, punishable by a prison sentence between 15 and 63 months.

Third-Degree Sexual Exploitation of a Minor

These offenses involve the possession of material that contains a visual representation of a minor engaging in sexual activity. Third-degree sexual exploitation of a minor is a Class H felony, punishable by 4 and 24 months in prison.

In addition to prison time, a conviction for a child pornography offense carries court-mandated sex offender registration for 30 years and lifetime probation.
